去年底（2020年12月27日），约定结束4.28日。我与南京艺佰年装饰工程有限公司（该公司位于南京市江宁区科建路29号有志大厦B座501室）签定了房屋装修合同。 在施工过程中，发生以下纠纷：

<spanyes;font-family:calibri;mso-fareast-font-family:宋体; mso-hansi-font-family:宋体;mso-bidi-font-family:宋体;line-height:130%;="" font-size:14.0000pt;"="">合同上约定的乳胶漆是德国原装进口的高档鲸彩乳胶漆，但在施工过程被换成了普通的雪朗白。</spanyes;font-family:calibri;mso-fareast-font-family:宋体;>鲸彩在京东的零售价是1500--1600元/10升，而雪朗白22升/桶的零售价只有六百多不到七百。其他暂时不说，光从零售价上来说，就知道哪个好。

在交涉的过程中，我曾提出先刷一遍硅藻泥作为底漆，再刷乳胶漆。后来，因为路官清提出了铲掉上面一层的乳胶漆，再批腻子、刷乳胶漆，我觉得可行，就没有要求刷硅藻泥了。

<spanyes;font-family:calibri;mso-fareast-font-family:宋体; mso-hansi-font-family:宋体;mso-bidi-font-family:宋体;line-height:130%;="" font-size:14.0000pt;"="">7月4日下午，我去他们公司选橱柜造型时，路官清无凭无据地提出要我付一桶硅藻泥费用，我说我压根没看到你的硅藻泥，怎么要我付费？他手机联系了曾在我家做过油漆的路师傅，路师傅在通话中信誓旦旦地说：他刷过了硅藻泥。然后，我把谈硅藻泥过程中的短信、微信以及手机的通话记录给他看。在详尽的证据面前，他当时哑口无言！ </spanyes;font-family:calibri;mso-fareast-font-family:宋体;>

<spanyes;font-family:宋体;mso-ascii-font-family:calibri; line-height:130%;font-weight:normal;font-size:16.0000pt;"="">8月20日晚，我在与路官清微信通话中指出他们在整改过程中没有滚刷底漆，路官清辩称：多滚刷两遍面漆可以代替底漆。而第三方检测报告明确指出：乳胶漆饰面滚刷必须底漆在先，乳胶漆底漆作用是：“抗碱、隔碱、防泛黄、封闭‘氨’之作用，是环保所必须，绝不可省略”。乳胶漆底漆没有滚刷必须返工，底漆在先！<spanyes;font-family:宋体;mso-ascii-font-family:calibri; line-height:130%;font-weight:normal;font-size:16.0000pt;"=""><o:p></o:p></spanyes;font-family:宋体;mso-ascii-font-family:calibri;></spanyes;font-family:宋体;mso-ascii-font-family:calibri;>

（2）墙面多处坑洼不平，裂纹

发现问题之后，我立即与路官清联系，说明我的要求：铲掉重做，但他只答应简单地修补。因为很多坑洼不平，都是由于基底的腻子没批好，打磨没磨平等因素引起的，简单的修补是无法解决实质性问题的。

鉴于艺佰年装饰在施工过程中出现种种恶劣言行，我认为艺佰年装饰在此项目中没有如实地履行合同约定的义务而是恶意地利用客户缺乏装修专业知识的弱点企图蒙骗客户（如省掉底漆，甚至混淆底漆与面漆）。所以，我认为艺佰年装饰公司不具备商业装修公司起码的诚信服务态度和专业能力。  

为维护本人的合法权利，特提出以下要求：

解除与艺佰年装饰签订的装修合同，并要求其退还不合格施工（墙顶面乳胶漆）和余下未施工的款项：RMB13248.6元
